TORRES AVILA, Jheison. Paradigms of Power control and the Principle of Division of Powers. Justicia Juris [online]. 2014, vol.10, n.1, pp.87-101. ISSN 1692-8571.

This article reviews the foundations upon which the modern concept of separation of powers was built. To achieve this goal, we take a look of the main influences and contributions of the great movements of liberal constitutionalism: the Glorious Revolution, the independence of the United States and the French Revolution. The control of power in the liberal state is established from the perspective of each of these processes and the implications of developments. Likewise, the reflection made by Locke and Montesquieu is highlighted. This reflection paper is the result of a research project entitled The Division of Powers and Judicial Control in the Constitution of 1991, sponsored by the University Santo Tomas.

Palavras-chave : Constitutionalism; control of power; separation of powers; judicial independence; rights; rule.
