Drug use in most of the world has been treated from a democratic aspect, with the challenge the participation of citizens in making decisions or contemplation of the subject by the legislature. But Colombia has been the exception since permissiveness and restriction of consumption has been developed by the courts. Is the Constitutional Court that on the occasion of his various statements has changed the treatment of consumption and who consumes, it should be. This reflection paper he realizes this legal problem. It was considered important to highlight the Colombian case against the other countries of Latin America. The research sought to determine whether legalization of psychoactive substances through the courts is challenging the democratic system or if instead the constitutional body empowered to intervene in this debate. To reach this goal we have identified and analyzed the regulatory treatment that has been given to the use of psychoactive substances in the major countries of Latin America.
