TMaternity leave is a right for women who are pregnant. In this article, the results of an investigation are presented to determine the legal protection that exists in Colombia on maternity leave for independent contributors. The specific objectives set out to review the maternity leave for independent contributors in the light of recent pronouncements of constitutional jurisprudence contributors; comparing maternity leave with the Republic of Peru; interpose a protection action as a means of access to maternity leave for freelance contributors. Through a case study with the inductive method. It is made this research that is qualitative, descriptive, and documentary. Primary sources are used such as observation and interview; secondary sources such as elaborations of authors on the subject, laws, jurisprudence. The findings represent the legal conflicts that arise on how women are directly affected
