The humanitarian crisis on the Afro-European border makes it urgent to examine European migration and refugee policies, an issue given by ultra-protective European conceptions. In reality, the Mediterranean and African migrations do not justify all these reservations. European policies are creating irreparable personal harms and damage to the foundations of the legal system, in addition to helping organized crime. This article analyzes all this set of aspects, contrasting the main measures practiced with the poor results obtained, an is- sue that only arises the outcry against the restrictive positions that have been developed on migrations. Unfortunately, it´s not possible to avoid Europe's responsibility in the greatest disaster in this matter.
