Bankruptcy is a legal institution totally forgotten in the Cuban legal practice, although not research on this subject has been developed by students of commercial law on the island. The need for implementing a commercial insolvency procedure responds to the recognition that new socio-economic conditions of the territory in safeguarding the interests of traders not only in the state sector but also the emerging private sector deserves. This research focuses on two key issues: first the doctrinal foundations of the institution are set to gain a better understanding of national problems and in the second the necessary budgets are described to establish the necessary criteria to merit its implementation in Cuba.
