Abstract

BLANCO ALVARADO, Carolina. Legislative harmonization in government contracting in the Andean Community: a Colombian perspective. Rev. Cient. Gen. José María Córdova [online]. 2022, vol.20, n.37, pp.226-241.  Epub Jan 01, 2022. ISSN 1900-6586.  https://doi.org/10.21830/19006586.859.

This article addresses the importance of legislative harmonization in government procurement in the Andean Community countries. To this end, the relationship between legislative harmonization and state contracts is identified. The main reasons that justify the proposals for legislative harmonization in this area are presented, and the obstacles faced by the consolidation of supranational normativity are analyzed, identifying the possible solutions to these obstacles. A qualitative and dogmatic research methodology was used, based on Colombian and Andean doctrine and laws, to explain the legal nature of the regulations on the subject. It is concluded that the Andean integration process, of which the proposed legislative harmonization is a part, is an ambitious and complex process, but with great benefits for its member countries.

Keywords : Andean integration; government contracting; intergovernmental organization; international law; supranational.
