Abstract

GOMEZ ISAZA, María Cristina; PABON MANTILLA, Ana Patricia  and  ESTUPINAN ACHURY, Liliana. The syndromes and challenges that the research in law in the colombian legal culture must overeóme. Rev. repub. [online]. 2020, n.28, pp.39-58. ISSN 1909-4450.  https://doi.org/10.21017/rev.repub.2020.v28.a76.

The text presented reflects on the weight of the legal tradition of the nineteenth century in the formulation of research projects in Law. The reflection is based on the review of the literature and the critical analysis of these texts. The result shows, in the first part, what we call the syndromes that afflict the law researcher when he starts his research project and that are linked to a rational and traditional vision of law. In a second part, the guidelines of what would be a research aproposal that exceeds the dogmatic tradition are exposed, in a context like the Colombian in which research is required to understand reality and that from that understanding derives its transformation.

Keywords : Legal research; positivism; critical theories; critical hermeneutics; new law.
