This article considers the proclamation of the cabildo abierto of Portoviejo, on December 16, 1821 and its importance in the annexation of the governorship of Cuenca, the province of Quito and, later, the Free Province of Guayaquil to the Republic of Colombia. To substantiate the territorial sovereignty of Colombia, several formulas were used to transfer the sovereignty of the provinces to the nascent republic. In the first place, the article explains the invocation of the uti possidetis iuris in the Fundamental Law of 1819, to legitimize the right of possession of the territories at the south of Popayán. Next, it analyzes the recognition of the principle of territorial possession by the cabildo portovejense. Thirdly, we consider the transfer formulas used to consolidate the annexation of Quito, through armed capitulation and pactist consent. Finally, Bolívar’s ignorance of Guayaquil’s independence is studied.
