Abstract

In this paper we analyze some of the advices given by Don Quixote to Sancho for the government of the Barataria Island. The purpose of the authors is to show that, despite the many modern elements of the novel, the advices reflect a classic -and non modern- conception of justice and law. This classical conception passes from the Middle Ages to Cervantes through the Second Scholastic, which, while facing modern problems, remains a current of thought anchored in the Aristotelian Thomistic doctrine of natural law. The methodology used is a legal philosophical analysis based on Cervantes sources.
