High-risk activities are those which have an impact on the health and well-being of the worker, because they demand an exposition to adverse factors. Consequently, they have been subject to national and international regulation, with the only propose to protect the rights of workers expose to extreme conditions for their health.
In accordance with the above, in the Colombian legal system these activities have had an important legislative development within the pension system, which seeks to provide workers who perform them with special protection, for the specific case, through an old-age pension in preferential conditions, which is defined in the standard and its transition regimes.
The regulations in question must adhere to the principles of social security, specifically the principle of progressivity and non-regression, in favor to the rights of workers who are at high risk. Therefore, this article seeks to determine if, as a consequence of the legislative changes, the analyzed principles are violated, to the detriment of the workers’ rights.
