The family is one of the most basic institutions of society, which has evolved over the years, leaving behind the traditional concepts that inspired it. This has allowed, for example, the recognition of the assembled lineages in our legal system. The Constitutional Court of Peru has affirmed to the members of these lineages a series of rights and duties in life, under the protection of the right to equality and non-discrimination. However, it omits to pronounce on the right to inheritance. We propose to analyze whether its reasoning so far is suitable, from a constitutional and international perspective, to extend its protection to the patrimonial rights from the inter vivos plane to the mortis causa and thus fill the existing normative void with regard to the institution that is the subject of this research; specifically, in the hereditary sphere in the parent-stepchild relationship.
