GONZALEZ GONZALEZ, Jorge Luis. International experiences of indigenous law and its application regarding the right to autonomy in Chile. rev.ces derecho [online]. 2023, vol.14, n.1, pp.61-87. Epub 16-Mayo-2023. ISSN 2145-7719. https://doi.org/10.21615/cesder.6774.
This work studies the right to autonomy of indigenous peoples from international experiences and tools linked to indigenous law, as a demand for social vindication that constitutes a disruptive dilemma in Chile today, because it directly confronts the nation-state model. The author proposes the theoretical construction of this right through the application of the dogmatic method, for which he analyzes the core of the right and its inherent content in order to determine its essential content, through the analysis of international standards derived from the International Law of Human Rights and International Law of indigenous peoples and comparative law, in order to propose its incorporation and application in the Chilean internal legal system. It is concluded that due to the polysemic nature in which this right has manifested itself, it could be exercised in different dimensions and different levels, in addition, this exercise and guarantee, be done progressively through legal normative instruments.
