Abstract

CARRASCO DELGADO, Nicolás. Access to civil justice in Chile from economic analysis of law. rev.ces derecho [online]. 2023, vol.14, n.2, pp.127-147.  Epub Oct 30, 2023. ISSN 2145-7719.  https://doi.org/10.21615/cesder.7378.

It has held that the civil procedure system in Chile presents problems of access to justice. This issue has been raised in the framework of the civil procedure reform. However, the quantitative studies that have been carried out allow us to dismiss these conclusions. The reasons for which people with juridical needs do not initiate legal proceedings is not necessarily due to a lack of access. To face this issue, the examination of problems of access is proposed from a perspective of efficiency, a viewpoint which in Chile has been mostly disconsidered in the discussion of the problem.

Keywords : access to justice; civil procedure law; economic analysis of law; efficiency; procedural reform.
