In this paper, we seek to define the sociodemographic characteristics and working conditions of artists who live in Chile and Mexico and how they are related to their exercise of rights. In order to do so, we designed an exploratory-explanatory research based on the primary data (n =94). For the analysis, the logistic regression model was used. The main results show how various sociodemographic characteristics (e.g. the fact of being a woman or a younger person) or working conditions (e.g. the fact of having a higher of income from an artistic job) are associated to a reduced access to social security, health services, adequate housing and the use of free time in the context of the COVID-19 pandemic. The aforementioned results point to the necessity of new public policies, programs and interventions to minimize the negative, current working conditions as a means to provide protection to artists' rights.
