Abstract
MORANTE, MARÍA FLORENCIA and MORANTE MARIANI, JOSÉ MARÍA. MULTIPLE ACCUSATIONS AND "EQUALITY OF ARMS" IN THE ARGENTINE ACCUSATORY SYSTEM. Novum Jus [online]. 2022, vol.16, n.1, pp.51-66. Epub Nov 07, 2022. ISSN 1692-6013. https://doi.org/10.14718/novumjus.2022.16.1.3.
One of the main principles of the accusatory system governing many of the Argentine provinces- including the Chaco, which was the first one to implement it-is equality of arms. Nevertheless, this is not effective in practice since both the prosecutor and potential plaintiffs can accuse the defendant. The present work proposes that, for there to be equality of arms, a legislative reform is needed, so that in cases where there are multiple accusations, only the plaintiffs complaint goes to the trial stage. In this way, the action would continue between the plaintiff and the defendant, leaving the representative of the Public Prosecutor's Office as the guarantor of legality.
