Federal Election Commission (Ciudadanos Unidos contra la Comisión de Elecciones Federales), dictada por la Corte Suprema de Estados Unidos como mecanismo de legalización de la influencia irrestricta del financiamiento privado en la política estadounidense. La hipótesis aquí es que esta modificación institucional legaliza, a su vez, una forma de corrupción política que se evidencia en la actual legislación restrictiva del voto. Se presentará un marco referencial en el que se definirán los conceptos que articulan el análisis. Luego, se hará una descripción de los antecedentes y el contexto de la sentencia Citizens United v. Federal Election Commission; en seguida, se realizará un análisis de la sentencia, para pasar luego al repaso de dos de sus consecuencias: la primera es la influencia del dinero negro (donaciones anónimas) tanto en las campañas como en la selección de jueces, y la siguiente es la exposición de la influencia del financiamiento privado ilimitado de las campañas en la legislación restrictiva actual del voto.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[Abstract This article studies the Citizens United v. Federal Election Commission ruling issued by the Scotus as a mechanism to legalize advocacy groups' unrestrictive influence on United States politics. The hypothesis here entails that the judiciary has legalized a corrupt practice reflected in restrictive voting legislation pushed forward by the Republican Party. The article first crafts a frame of reference to display definitions, then describes the background and context of the decision itself, and finally, considers the last two outcomes of the ruling: dark money rising influence on US politics and advocacy groups' unlimited influence on currently restrictive voting legislation.]]></p></abstract>
<abstract abstract-type="short" xml:lang="pt"><p><![CDATA[Resumo Neste artigo, a sentença Cidadãos Unidos versus a Comissão de Eleições Federais (Citizens United v. Federal Election Commission), proferida pela Suprema Corte dos Estados Unidos da América em 2010, é estudada como um mecanismo para legalizar a influência irrestrita do financiamento privado na política americana. Levanta-se a hipótese de que essa modificação institucional, por sua vez, legaliza uma forma de corrupção política que é evidenciada na atual legislação de voto restritivo. Para dar seguimento ao estudo proposto, é apresentado um quadro referencial no qual são definidos os conceitos que articulam a análise. Em seguida, no desenvolvimento do artigo, são descritos os antecedentes e o contexto da sentença, para então passar a analisar duas de suas consequências: a primera é a influência do black money (doações anônimas) tanto nas campanhas quanto na seleção dos juízes, e a segunda é a exposição da influência do financiamento privado ilimitado das campanhas na legislação eleitoral restritiva em vigor.]]></p></abstract>
