Aceptando la idea principal de que las decisiones pueden gradarse según su legitimidad democrática, cuestiona que la Ley de Caducidad uruguaya haya sido legítima en un grado significativo y por tanto haya debido respetarse en su validez por la Corte Interamericana. Ello por cuanto la decisión no fue tomada por todas las personas posiblemente afectadas por la misma. Este principio normativo de inclusión es fundamental para la teoría de la democracia de Gargarella, sin embargo, no fue considerado en su análisis del caso. El artículo explora las consecuencias de tomarse en serio el principio de inclusión y los problemas prácticos que este apareja, en especial respecto de la constitución del demos. Finalmente, propone una alternativa de solución mediante la justicia constitucional/convencional, de acuerdo con un entendimiento procedimental de la misma basado en la participación, según lo pensó J. H. Ely.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[ABSTRACT The article raises some questions about Gargarella's analysis of the Inter-American Court of Human Rights' ruling in Gelman v. Uruguay. It accepts the main idea regarding the possibility to grad democratic legitimacy of decisions, but it questions that the Uruguayan amnesty has had a high degree of legitimacy. This is because the decision was not made by all possibly affected people. This normative principle of inclusion is fundamental to Gargarella's theory of democracy, however, it was not considered in his analysis of the case. The article explores the consequences of taking the principle of inclusion seriously and the practical problems that it involves, especially regarding the constitution of the demos. Finally, it proposes an alternative solution through a procedural understanding of judicial review based on participation, as proposed by J.H. Ely.]]></p></abstract>
