Se sugiere que existen cuatro "mitos" que se erigen sobre la base de tesis comúnmente aceptadas por parte relevante de la doctrina dedicada a la teoría del Estado (y, en cierta medida, la teoría del derecho), e incluso a veces respaldada en textos constitucionales vigentes. Los mitos son: 1. La separación de poderes del Estado exige separación de facultades; 2. La función de la Administración se limita a la ejecución de normas legales; 3. La potestad normativa de la Administración es contraria a principios morales del derecho, y 4. 'Ejecución de normas legales' y 'creación normativa' son mutuamente excluyentes. Estos mitos han impedido la construcción de una defensa sólida en favor de la potestad normativa de la Administración en el Estado moderno, razón por la cual se proponen elementos para su revisión.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[ABSTRACT This article seeks to offer a critique to the idea that rulemaking powers exercised by the Administration are illegitimate or somehow unlawful. I suggest that four "myths" are commonly accepted by a considerable group of scholars devoted to the research of the theory of the State (and, to some extent, jurisprudence), and are even sometimes supported by existing constitutional texts. The myths are: 1. Separation of powers requires separation of "types of powers"; 2. The role of the Administration is limited to the enforcement of legal rules; 3. Administrative rulemaking power contradicts moral principles of law, and 4. 'Enforcement of legal rules' and 'creation of rules' exclude each other. These myths have prevented the elaboration of a strong defense in favor of administrative rulemaking power in the modern State. This is why I present some arguments that allow for their review.]]></p></abstract>
