Para eso, el artículo adoptó la investigación documental y bibliográfica como técnica de investigación. Como método de investigación, el método inductivo partió de preguntas particulares de los países analizados hasta una conclusión sobre el tema de investigación. Se concluyó que hay necesidad de relectura de los derechos constitucionales ante el nuevo escenario y es imperativa la adopción de una interpretación constitucional menos dañina.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[ABSTRACT This article objective is to analyze the restrictions to constitutional rights during states of emergency in the Brazilian and international jurisprudence. For that, the article employed a documentary and bibliographical review as a research technique. As a research method, the inductive model was supported on particular questions of the countries reviewed up to a conclusion on the research topic. The research concluded that there is a need for re-reading the constitutional rights in the light of the new scenario and it is imperative to adopt a less harmful constitutional interpretation.]]></p></abstract>
<abstract abstract-type="short" xml:lang="pt"><p><![CDATA[RESUMO Este artigo tem o objetivo de analisar as restrigóes dos direitos constitucionais durante estados de excegao na jurisprudencia brasileira e internacional. Para isso, adotou a pesquisa documental e bibliográfica como técnica de pesquisa. Como método de pesquisa, foi utilizado o método indutivo, o qual partiu de perguntas particulares dos países analisados até uma conclusao sobre o tema de pesquisa. Conclui-se que há necessidade de releitura dos direitos constitucionais ante o novo cenário e é imperativa a adogao de uma interpretagao constitucional menos nociva.]]></p></abstract>
